These Terms of Service ("Terms") govern your access to and use of the BLU website (blu.luxe) and platform (the "Service"), provided by BLU ("BLU", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. For any questions, contact us at corp@blu.luxe.
The Service
BLU is a B2B software platform that helps creators and agencies manage client communications, messaging automation, and analytics. BLU is a tool: we provide software, and money from fans or end customers never passes through BLU. We may improve, change, or discontinue features over time to keep the product useful and secure.
Eligibility — Adults Only (18+)
The Service is a professional tool for businesses in the adult-content industry and is strictly for adults aged 18 or older. By using the Service, you represent that you are at least 18 years old and that you have the authority to accept these Terms on behalf of the business or account you represent. The Service is not directed to minors.
Accounts & Security
You are responsible for your account credentials and for all activity that happens under your account. Keep your login details confidential and use strong, unique passwords. If you believe your account has been accessed without your permission, tell us right away at corp@blu.luxe so we can help secure it.
Acceptable Use
You agree to use the Service lawfully and only for its intended purpose. You will not misuse, reverse-engineer, overload, or disrupt the Service, attempt to access it without authorization, or use it to break any law. You are responsible for complying with the terms and policies of any third-party platforms you connect to BLU, and for the content and data you process through the Service.
Your Data & Third-Party Connections
You may connect or authorize third-party accounts and data so the platform can do its job. You represent that you have the rights and permissions needed to do so, and you remain responsible for that data and for complying with applicable laws and third-party terms. We handle personal data as described in our Privacy Policy.
Fees & Subscriptions
Paid plans are billed according to the plan you choose. Any free trial converts to a paid plan or expires according to the offer presented to you. Fees cover the software subscription only — BLU does not process or hold fan or end-customer payments, which are handled by your own payment processors. Taxes may apply depending on your location.
Intellectual Property
BLU and its software, brand, and content are owned by BLU and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business while these Terms are in effect. You keep ownership of your own data and content; you grant us only the permissions we need to operate the Service for you.
Third-Party Services
The Service may integrate or link to third-party products and services. We are not responsible for third-party services, and their own terms and privacy policies apply to your use of them. Any dealings you have with third parties are between you and them.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We work hard to keep the Service reliable and secure, but we do not guarantee that it will be uninterrupted, error-free, or that it will meet every specific requirement.
Limitation of Liability
To the maximum extent permitted by law, BLU will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the claim.
Termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms or misuse the Service, or if we need to for legal or security reasons. Sections that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will continue to apply.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms here with a new date. If you keep using the Service after changes take effect, that means you accept the updated Terms.
Governing Law & Contact
